Question posted in the General Law category relating to Eastern Cape

Good morning

My name is Likhaya Mgangxela representing Super Eagles Cricket Club in East London & wanted to find out from you about our legal rights in a matter against Border Cricket Board.

We have been playing in the Border Premier League fr the past 12 years we got relegated last year so we played Promotional League from October 2019 until March 2020, we had 1 game remaining when on the Monday of the last game Cricket South Africa declared 60 days of no Cricket effectively ending the season.

When this Pandemic struck we were leading by 15 points so we had in effect won the league & automatic promotion was guaranteed to Premier League was secure, the last game was a mere formality. Premier League on the other hand had 2 games to be played & it was a dog fight with 4 teams fighting it out in the relegation battle only 1 team gets relegated & only 1 team is promoted to Premier League.

Now we hear that the Cricket Club Committee which consists of Clubs has closed ranks & has dvised the Board of Directors to declare the cricket season null & void, we are waiting for the Board to vote on the issue. We seek Legal advice on the issue as we cannot understand the following :

1) How can the cricket season be null & void after 90% of it has been completed?

2) Can a season be declared null & void if a champion in a contending league has already been determined?

3) Does the null & Void process not apply when no winner's are determined when the league season cannot possibly resume?

In other provinces winners have been declared, clearly we feel victimized because this resolution doesn't take into consideration our promotion hence we want to see our legal options because we cannot take this lying down. We feel Certain teams receive protection & decisions are taken to benefit them.

Kind Regards

Likhaya Mgangxela
