I need some advice regarding a situation I am facing with a car sale. Four weeks ago, I sold my car for R34,000, but the buyer only paid R28,000 as agreed upon in an affidavit we both signed. The agreement outlined that the remaining amount would be paid monthly, and I provided him with all the necessary paperwork, fully disclosing any issues the car had. I was honest about the car's condition, and he took it without hesitation.
However, now, after four weeks, the buyer has not made any further payments, and he is refusing to pay the remaining balance. Worse, he is demanding that I return the car and give him back his money. This is a significant issue for me because I have already used the money I received from the sale.
Could you please advise me on what steps I can take in this situation? I want to ensure that my rights are protected and that I can resolve this matter fairly. Should I pursue legal action, or are there any other options available to me?
