If you agree to purchase a property and agree to pay occupational interest for a "reasonable" amount of time. What is considered reasonable? In my case the conveyancer has taken 18 months to obtain clearance figures. We notified him after making our fourth payment of occupational interest that we cannot affort to keep paying the occupational interest indefinitely. He has the clearance figures and is in a position to conclude the transfer but refuses to because there is a dispute on the occupational interest. We have offered to pay the costs that the seller may have incurred as a result of the dely even though the delay was not in our control. The conveyancer says that our offer was irrational. What are we meant to do? I would even accept cancelling the sale and finding a different property. My mother has lived in a house for 18 months and put the cash in the conveyancers trust account 18 months ago but still does not have a property on her name. Surely this cannot be acceptable.
