I moved into into a house in Randburg in February 2014.
When I moved in, I paid the deposit, first months rent and an admin fee directly into the account of the estate agents, Centuary 21.
I had to move in a week late because they were still fixing the place and therefore paid a prorata amount for the March rent.
I moved out exactly a year later at the end of the month (Feb 2015). The lease agreement lapsed at the end of January and the only stipulation in the lease agreement was that should I wish to extend the lease, I would need to give 2 months notice. My understanding was that after the lease agreement lapsed, the contract went on a month to month basis, which the Estate agent agreed with.
Now the landlord refuses to pay back my deposit and they are claiming that I did not report contuniung damage to the property which is a blatant lie. The only issue is that I do not have my reports in writing.
Now I need to know if I can hold the estate agent liable for enforcing the payment of my deposit back to me?
What are my legal options?
