Question posted in the Landlord Tenant Law category relating to Eastern Cape
I did ask 2 questions. One was answered, but the one that was not answered was if we paid rent in advance, do we get interest on that amount? There was no dispute. She accused us of stealing her son's lures. We pointed out to her that her son takes his friends into the garage. She said we could use her garage to store our things. Then demanded that we move them, which we did. However, now we are accused of letting the dog out, which she herself has done this morning. The reason for the rent being paid so far in advance is that she purchased items from and instead of paying for the items she said she would take it off the rent. If she does not have the funds to repay us, may we re-possess items to the value of the rent she owes us?

When you were evicted, was there an amount of rental that you owed the landlord still? If so, then the landlord would claim this deposit as part of his damages.
If there was nothing owing to the landlord, then you should most certainly get your deposit plus interest back.
The question that I have is why were you evicted from the property if you were up to date on your rental? Was that in dispute?

Thank you very much for your reply. But, I would also like to know if we can request interest on the rent paid in advance. It is paid in advance for over a year. The reason we paid so far in advance was she purchased items from us and rather than pay us, she would take it off the rent. The landlady accused us of stealing. Her son's fishing lures had disappeared. My husband mentioned that her son often brought his friends to the garage.
