Good morning,
I've been under administration since May 2007. In June 2012 I wanted to settle my admin order as I've had enough money to do so. At that time according to the distribution order I've received from my administrators, I owed just above R8000. However, after they got the final balances from my creditors, it went up to R37000, my administrators just told me that in the 5 years prior, they've asked for statements several time, but never received them from the creditors. Now again, we wanted to settle it, it was around R13000 now. However again, the same happened, my balance went up to R23000 already, and there is still 2 creditors's balances that needs to be added. How is it fair, that my administrators ( a legal attorney), is taking 12.5% every month from my premium, but don't reconcile my creditors and these stuff happens every time I want to settle. Aren't they suppose to keep these balance up to date & correct at all times? When I complain to them, they just tell me that this is how it works, and that I must pay my creditors until they are all paid up.
There is also one creditor, that phoned me in 2012 (NRB Risk Solutions) and told me that I owe STD Bank over R12000 for a overdraft cheque account since 2007. Now according to my knowledge, if no payment was received for 3 years, the debt should by written off. I've told them several times that I'm under admin since 2007 and gave them my Attorneys' contact details. According to me this account, was also under the admin debt. What happens with this now? My feeling is that nobody ever phoned me with regards to this since 2007, only in 2012 for the first time and after 1000's of rands of interest have been added. Is this even legal?
