Question posted in the General Law category relating to Eastern Cape
I have a telephone pole on my property, but since no one uses telephones and it has not been a problem.
Now Open Serve Fibre is being installed in the area and the technicians want access to my property. I don't want to give them access as I go away a lot, and this will be a clear giveaway for my safety if they are allowed on the property, oass locked gates and an alarm system.
They have given me a letter stating they have rights to access my property with or without my permission, quoting the telecommunications Act36 of 2005.
I bought the property with the telephone poles on it, and never gave my permission for it
Can I deny them access and call the police for trespassing if they clime over my fence
