Hi there, I am the rental agent of a property being sold on auction about 3 weeks ago. The Buyer ("new" owner) demanded that the tenant pay rent directly to him. He also demands the deposit in my trust account to be refunded to the tenant. In the interim, the current ("previous" owner) has filed for sequestration and some legal procedure to reverse the auction. She has instructed me to not refund the deposit.
Are we (the current owner) and I correct or not? Transfer (registration) of the property has not taken place yet, the property is not registered onto the buyer's name. He claims that the property is already his and that he is entitled to the rent and the deposit be refunded.
Please advise urgently since the new buyer and current tenant are threatening me with all sorts of legal steps.
