Question posted in the Criminal Law category relating to Gauteng
I am writing to seek your legal advice and assistance regarding a serious matter involving the estate of my late father.
After my father’s death, there was no will or formal documentation indicating the distribution of his estate. However, my mother, without our knowledge or consent, collaborated with her lawyer to forge my and my siblings’ signatures on a document appointing her as the executor of the estate. Following this, she proceeded to deplete the entire estate, which amounted to approximately R3 million.
This fraudulent activity has come to light, and I believe legal action is necessary to address the situation. I am deeply concerned about the illegitimacy of her actions and the loss of what should have been rightfully preserved for the heirs of the estate.
I would like to understand:
1. The legal consequences my mother and her lawyer may face for forging our signatures.
