Question posted in the General Law category relating to Western Cape
Hi - we are renting a place. We signed a one year lease and paid 6 months up front. On entering the house there were a number of issues whereby we could just not stay with two small children. We therefore informed the landlords after one month that we would be leaving however gave them 3 months to find another tenant which they did very quickly as the rental market is very good here. The new tenants have signed a lease and paid two month upfront, however the landlords are refusing to refund us the remining two months rent we pre paid. BUT they will have a tenant in place for those two months and we gave them three months to find a new tenant. So as it stands they have our 2 months pre paid rent plus another two months deposit. Should they be paying the prepaid rent back now that they have found new tenants which have paid two months in advance?
