Good day

My question is regarding child support.
My husband and I have been married for 2years and we have been struggeling to get by for a while. My husband has a child out of wedlock, but nor where they in a relationship. At his son's age of 1 and a half he was approached for child support and it was determined that it is more than likely his child by blood tests.

He has been paying child support in accordance to the court sins then. He had no legal reperisintation during this time and was just to happy to meet his son to ask what is his rights. His son is now 5.

Now after 2 years of planing and waiting we would like to start a family of our own, but our current costs run round about R4500 in support towards his son. The mother had been engaged on and off for 5years and lived with the fiance, whom had no stable income. After a dispute about more money we have saught legal help, but now only 2months before the court date she has moved out of the fiances place and in with my husbands parents.

Does this change our legal grounds on which we are appealing? And if so, why?

We pay school fees, after school care, medical aid and money to her each month. We also drive to fetch him every second weekend for fisitations 200km away from our own home. My inlawes pay for all extra activities out side of school and now she lives with them rent and board free.

Would we be able to even to fight for custody?
