Greeting your Exellency i am frans from Vanderbijlpark.The situation is that my parents divorced in 2007 but continued staying in the same house, my mother won the custody of us 3 minor children. According to the decree divorce which is with my father it states clearly that the estate should be divided and maintanence should be applied for by my mother . After fews months from the divorce my father kicked my mom out of the house with some funiture which they have shared, he also wanted me to leave but i refused since i was near the school. My other siblings where living with my grandma at that time. Since we had no stable place to stay and me staying with my father was painful because he tried so may times to kick me out also. Now apparently my father did not buyout my mother or my mother did not get any equity, share or cash.He still lives in that house with her girlfriend but the house is in the name of my mother and my father. When they divorced my mother was working as a domestic worker .We dont have a home me, my mother and my sibling . my question is how do we get the house back or what must we do to get my father to buyout my other and also he is not doing anything for us so can we claim maintanence thank you
