I have 2 questions please:

Me and my wife have been married for 43 years and are married in community of property before 1982.

My wife had not been working for the last 15 years.

In that time we entered into several loan accounts and hire purchase agreements. The total outstading ammount is +/-R400,00

We now want to divorce and she claim that her attorney advised her that she is not 50% responsibile for our joint debts?


Can you please advise?

Question 2
I sold my house two years ago and I used the money that was over after repaying the bond to build a flat onto my daughters house. I paid R600,000 for the building cost for which I have proof of. The house is in my daughter name and my wife will have living rights for occupation
Can this amount be added into our joint assets and liabilities to access our assets?

I want to split our total assets and liabilities 50/50.
