Must a company publish its policies to the employees or make them available, and if not can the company use the policy to favor one group of employees over another. Before notification we all qualified for a cash settlement to buy us out of our medical aid contracts. The company is telling us that the policy says that only pensionable aged employees qualify for the agreed settlement after notification of retrenchment.The fact is that this policy was never published. Would this be a case for discrimination with the CCMA as the company is favoring one group over another.
