I am in the middle of a maintenancne issue with my sons father. He has applied for a decrease in maintenance so I have applied for an increase. I am still under cross examination, the father hasnt been asked to take the stand yet. Before the trial even started the magistrate told us 'our case is doomed to fail'.....before hearing any evidence etc. This magistrate is very biased towards the other side due to them having employed an advocate and attorney as their defence.
The advocate who is cross examining me has been asking about my husband, his earnings etc....this has nothing to do with my husband....please assist....
My lawyer aplied for a recusal based on the bias of the magistrate towards the other side...this magistrate refused to step down and has instructed the trial to continue...please help...
