Good day, may I request speaking to a legal advisor in or from South Africa because this relates to a vehicle I bought at Parow SAPS, Cape Town? I bought the vehicle on the 18th of July 2019. Since the day I bought it almost everything mechanical gave in.
The person I purchased the vehicle from provided me with a six month guarantee on an affidavit. He also provided a false address on the affidavit. The actual address is 2.5km away in a 'not very safe' suburb of Cape Town. We did take the vehicle there for repairs a week after I bought the vehicle. He provided me with the 'real' address on that very morning. We found the premises within an informal settlement, completely lacking security, a workshop or any proper infrastructure relating to mechanical repairs. There are no workshop. The vehicles taken there for repairs are left exposed to the elements including the mechanics. Clients, mechanics, residents, pedestrians and vagrants enter and exit the open premises on a continuous basis. Leaving a vehicle there unattended, let alone overnight, will be most unwise. They also performed poor repairs on the vehicle as they lack materials and tools to do mechanical repairs. He also refused and ignored many of the repairs I needed done on the vehicle. When my husband and I drove the vehicle back home dirt passed through the carburetor into the engine. Driving back home was an uphill battle. The CVs and gearbox also gave in soon after.
The seller of the vehicle informed me that they don't offer towing services and that he won't take any liability for theft or damages to my vehicle if I return it for repairs. I'll also have to leave the vehicle there for several days or even more than a week for repairs. If my vehicle was left secure in a decent workshop I would not have a problem with it but that's not the case.
I wrote an entire statement relating to this incident. There is so much more to tell. My question is this: If I take this matter to court for a small claim what are my chances for winning this case?
