Question posted in the Landlord Tenant Law category relating to KwaZulu-Natal

Hi

Please can you help with some advice. We have a tenant, who has been living in our premises for two months now and on both months have been delayed with rent payments. We do not have a written rental agreement but took them on out of their desperation for a home on a "gentleman's agreement". On asking for the rent they became rude and arrogorant. We now want them to move out but they say by law we need to give them 3 months notice, even though we have no written contract. What are my options. Please help
