Question posted in the Landlord Tenant Law category relating to Western Cape
Good day,
I have had an agreement with my owner and have a old rental agreement to pay a lower rent and pay the city of cape town bills, do repairs in the house and take care of it and remove the money from the rent. In short take care of the house as if i was the owner as the owner was abroad.I apy my rent on the account of hhis best friend monthly.
The man died and I am left living in a house nobody cares about. i had issues with my city of cape town bills that show amount of water usage completly impossible given I live alone. I did get leak professional company to come check and it is fine. City of cape town said the amount on the meter is the same as on the bill and if I want to check if the meter is faulty the owner needs to go to the municipality and pay to get the meter checked. If water is stolen, the insurance of the owner needs to investigate.
I had contracted a building insurance on the name of the owner when he was still alived but I cancelled it at a time I thought I was living the property ( and finally did not) and now I can't register for another building insurance on the name of a dead person.
I keep on taking care of the property but it is getting very not normal and I can't pay 10k city of cape town bill just because the meter is faulty or someone steals water from the property.
The friend of the dead owner told me I needed to pay otherwise I would have to leave now.
I am in the process of moving out, I jsut bought a property but I gave notice for the 1st february. I litterally have nowhere to go until that time.
No heirs have been yet identified and I am left in the middle of situation where because I am honest I feel bad to not pay but in the same time it is way more expensive than what any tenant should have to pay and I don't know what to do.
Thanks for your help
