Good day,

I urgently need advice

We stayed at place for +- 26 months. The first 12 months we had a signed contract. After that we did not received a new contract. We basicly stayed on a month-to-month contract. On the 03/11/19 we gave the landlord notice. On the 30/11/19 we moved out. The landlord refuse to payback our deposit. She first said that her contract state that we should give 2months notice. Then she said if she can get new tenants asap she will pay the deposit. In the same sentence she said that the viewing times we gave her did not fit the viewers. We said she is welcome to bring viewers between 17:15 to 18:00. My husband and I have both full time jobs. The landlord did not once phone and ask if she can bring someone during the day.

What is my rights as a tenant to get my deposit back?

As far as my knowledge go, if you rent on a month-to-month basis 30 days notice is sufficient.

Regards

Nadia
