Question posted in the General Law category relating to Eastern Cape
I'm needing advice on how to take legal action against someone who borrowed a large sum of money to buy a car , I have a written agreement from him agreeing on paying each month , so far I have had only two payments and nothing in the last 2 month, do I have a right to take the car back, He is a very manipulative person and has sevens then managed to manuplate more money out of me .
Message from the Attorney
Hi there and thank you for your question,
I am a practicing attorney based in South Africa and I will assist you with your question. Please feel free to ask as many follow up questions in order to clarify your question. If you have a new question, you must please open a new thread.
If you have an agreement with this person as to paying you back, then you must issue a summons out of the Magistrates Court and sue him for the money! If it is less than R20,000 you can also sue out of the small claims court.
If there is a part of the answer which you need more advice on, or clarity please continue in this same thread instead of opening a new question.
