Some advice please from the Legal eagles, please – When a Merit opinion is sought from an Advocate following serious concerns of how a matter is handled, and the opinion is returned validating the concerns, ie: negligence, and is later revealed that the company with whom the legal matter is being handled (and who subsequently outsourced the case to a lawyer) they too believe that their legal expert tasked in a matter was negligent in the handling of the case from the beginning. Question: What is required in law to prove this in a court or is it even necessary when negligence has been confirmed and acknowledged (in writing and recorded telecoms).Question: What are the most vital criteria in proving negligence, especially professional negligence and the duty of care by professionals?Question: Who ultimately is responsible for the negligence?
