Question posted in the General Law category relating to Western Cape
I entered into a written purchase agreement with We buy Cars for the sale of my secondhand motorcycle on 6 May 2022. They were supposed to collect the motorcycle later, on 9 May. On 16 May, the agent asked me if I knew the motorcycle was code 3, and I said yes, it was on the NATIS document I showed him on the day we signed the agreement, and he took it with him, and he replied ok. Again followed up, but the agent kept having excuses for not coming to collect the motorcycle. N 20 May, he said the deal is in for payment, and I can expect payment before the end of the day, and again, nothing. Eventually, on 25 May, he sent me a message saying that they could not buy the motorcycle anymore because it was a code 3 and he made a mistake by not picking up it was a code 3. e informed me they cancelled the agreement because your motorcycle was code 3 and it was an honest mistake. I had other buyers interested but informed them that the motorcycle was sold and not available anymore. Now I don't have another buyer, and We buy cars and want to cancel the deal. Next is the purchase agreement with no clause for cancellation:PURCHASE AGREEMENT
