Question posted in the Criminal Law category relating to KwaZulu-Natal
My question is, is it constituted for a criminal case to resume from the start when witnesses have already presented their evidence before Court? Previously I was arrested and my case ready to go on trial. When two police officers were to come and bring their evidence the trail judge changed and months later was told that my case will start from zero. The witnesses will again be called to present themselves. So now my mind is perplexed and thoughts disjointed as am lost and feel as if there's something unjust. Because was never given the opportunity to accept or oppose same as I was just told that my case will resume from stretch and previous statements will not be used but everything to start over. So it's hard and don't know what's going to happen as the case is wasting my time and have stayed incarceration from almost three years now
