Question posted in the General Law category relating to Western Cape

I have a telephone pole on my property, even though I do not even require it for myself, but our neigbours line goes across ours to the other neigbour.

Now Open Serve Fibre is being installed in the area and the technicians want access to my property. I don't want to give them access to avoid them from doing any other further installations because me and my fiance actually want to utilise that space for ourselves.

They have given me a letter stating they have rights to access my property with or without my permission, quoting the telecommunications Act36 of 2005.

I bought the property with the telephone poles on it, and never gave permission on it.

I just want to know my rights on the matter.
