Question posted in the General Law category relating to Gauteng
Good day
My step father has passed away in January 2023. He has one minor son of 17 years old. His other 2 children he signed away his custody when they were very young. His mother keeps saying there is a court order for him that he must go to the high court. No one has seen this court order and he has not been handed anything. She also wants him to sign a letter to make her executor of the estate. Is it legal to make a 17 year old sign any letter to say this person will be the executor of his father's estate? Can a court order be issued for a 17 year old and if he doesn't receive the order how must he know about why he is being summoned to court? Can one appoint yourself as a executor of an estate?
