Hi, I was involved in an accident on 2 September 2014. The other driver was at fault and admitted this to me and the police. My car, which is my livelyhood because I am a sales rep, was written off in the accident. His insurer now wants to pay me R17000 to replace my car. They are deducting 30% off the book value and then another 20% from that amount to get to R17000. I would like to know if I can sue him for the replacement value of my car not book value minus all these other amounts. Due to this accident I almost lost my job because I did not have insurance on my car and could not just go out and by another car. I have now loaned money (which I cannot pay back) to buy another car just to prevent from losing my job.
