Question posted in the General Law category relating to Western Cape
I am renting a car from a car rental business for almost a year. I didn't pay the current month's invoice on the due date and received an email from the rental agent that they can now switch the car off remotely should they not receive upfront payment. There is no mention of this in the terms and conditions or contract that I signed. It only states that they reserve the right to charge interest on late payments.
This morning my car didn't start due to it being switched off.
Are they not in breach of their own contract by not getting me to sign and acknowledge that they will be taking this course of action for late payments from now on?
