Question posted in the Property Law category relating to Gauteng
My parents bought life right of a house in a retirement estate. The life right remains until both has passed on or if they provide notice that they are moving out. My Father died in January 2023 and my Mother continued to pay the levy of the house until 31 May 2023 when we have given notice to them as she relocated to a new retirement village closer to her children. The retirement estate now claims that the money to be returned to my mother is payable to the estate and not to her. Could you please clarfiy why that would be the case? Say my mother stayed on for another 5 years after the death of my Father, does that mean the money to be returned is still payable to the estate as the estate by that time may have been finalised and closed?
