My father passed away and there is R252 000 in his bank account. Prior to his death he found out that the landlady had stolen or embezzled more than R300 000 from his account. A case was opened and is still pending. My stepmother is claiming the full R252 000. Should the courts not freeze the account untill the R300 000 plus has been reclaimed and then share the money according to the Law of Succession?
