Jane is employed at Best Properties (Pty) Ltd as an agent. Pamela, who stays in and owns an apartment inSilver lakes, decides to relocate to Bloemfontein to explore new business opportunities. For thisreason, she decides to let-out her apartment for rental. She approaches Best Properties (Pty) Ltd tofacilitate the lease of the property. Best Properties (Pty) Ltd advertises Pamela’s apartment in Silverlakes through Property42. Temba, who is interested in renting the property, contacts Jane to arrangefor viewing. On 24 February 2024, Jane and Temba meet at the apartment in Silver lakes for viewing.Temba is impressed with the apartment and expresses an intention to conclude a 6 months’ leaseagreement from 1 March 2024 to 31 August 2024. Jane affirms to Temba that the apartment he(Temba) viewed was the one Pamela intended on renting out. With this understanding, Temba advisesJane to proceed in preparing the offer for lease. The lease offer was prepared and sent to Temba foracceptance on 25 February 2024. On 26 February 2024, Temba discovered that the propertydescribed in the signed lease agreement is not the property he had viewed with Jane on 24 February2024.
