Question posted in the Property Law category relating to Western Cape
My mom has for a very long time rented her maids quarters to a mature couple for less than R1500 per month excl water and electricity. Currently the husband stays on the property alone as the wife has dimentia and is in a home. Their vehicle has leaked oil for eternity and has messed the paving, the kitchen tops was fire damaged and must still be replaced and the interior has never been cleaned / repainted.
As it is going to cost her a substantial amount to repair the place, has she given him 6 month notice to vacate the place and hopefully repair some of the damage he is accountable for. There is no lease agreement as they were staying there on a month to month arrangement.
Is she within her rights and is the notice period in order?
