Question posted in the Landlord Tenant Law category relating to Western Cape
My partner and I have a joint lease. I gave notice to the agent but retracted it as he had no place to go. I still ended up moving though. I asked the agent whether they could remove my name from the lease as we had a month to month lease and did not renew the old one. She said that they need to have both our names on the lease. This conversation happened in January. She brought the new lease two weeks ago (9th July). The issue is that my ex partner has not paid the rent for two months and I desperately want to cut all ties as I am facing many financial burdens still as a result of his decisions even though we no longer together. My question: Is there any way I can get my name removed from the lease (I did not sign the one she brought yet so its still on month to month) How to I get the agent to seek the outstanding rent from him only rather than me. I have not set foot on that property since I moved the begining of the year. Please help
