My husband was previously married in church with his ex. They have 2 children together. Their marriage was not recognised on the home affairs system as the pastor that married them passed away before comleting the process. My husband and his ex never followed up such as to get an original marriage certificate and to apply for a new ID. So when my husband and i married at home affairs last year we first queried that issue and it was said their marriage was invalid and ours is legal. We recently went to see a private lawyer as his ex is claiming im married to a married man and the lawyer agrees with her and says home affairs doesnt know what they doing and saying. Now im concerned about my marriage... Is it valid? What happens if they are still married? Can she claim half of our assets we have now made together? Please help as im a miserable stressed out mom now of a 9 month old baby girl and she feels the tension as this issue has now become a daily domestic issue between my husband and i.
