Question posted in the General Law category relating to Gauteng
Hi there,
My brother is driving a vehicle that is financed in my dad's name. My brother took the car to a mechanic to have a few repairs done. When my brother received the quote it stated that they would require a 70% deposit in order to start the work. He never paid the deposit (been trying to get the money together), and because of this delay the mechanic has had the vehicle removed from the premises. My dad didn't know all this was happening, and when he became aware that my brother didn't have the car in his possession, and that it had been taken to a mechanic, he got in contact with them to find out where the car is. After 2 weeks of trying to get any information from them he was told that the car has been handed over to a debt collector. Is this legal? They said that no work was done to the vehicle due to the deposit not being paid. They also won't give any information as to who the debt collector is.
