Hi

I emigrated 5 years ago to Germany, my two boys stayed in SA with their mom.

They are now 18 and 21, my adjusted divorce agreement states we need to support them until they are financially stable.

She is now leaving to go live in Italy, she is taking the 18-year-old with her.

The 21-year-old is busy studying at an institute in Midrand and only finishes at the end of 2026. So, he will need to stay one year alone in SA.

She is not contributing to his studies even though it states she should be paying 50 %

She has also stated that she will not support one child once she leaves in December this year.

What are my options? I know once she leaves, I will never get a cent out of her.

We have been divorced for 13 years and she always had an excuse not to pay her part.

I had to take her to court to get her to start paying school fees, which she only paid the last 5 years.

I just need some advice, I’m happy to pay for your time if you need to look through our agreements.
