Question posted in the General Law category relating to KwaZulu-Natal


In my contract it states the company offers its employees after one year of service a compulsary memebership of Momentums Investo Corportate Retirement Annuity. The employee will contribute 5% of gross monthly salary and the company in its sole absolute sol discrestion will, but not be obliged to, contribute towards the premium a sum equal to 5% of the employees gross fixed salary.





This was signed and agreed apon on the 01 Aug 2015 and the company has never stuck to this agreed apon part of the contract.





The contact also states that I have to give them 3 months notice if I resign.





Please advise, due to the fact that they have not honered the agreed apon RA do I have to stick to the 3 months notice period as they were in breach of contract after 1 year of signing
