Question posted in the Property Law category relating to Gauteng
Good day
A residential lease was signed on 6 August 2019 to start 1 September 2019. Part deposit was paid. Occupation of premises was then moved to 1 October by the tenant and agreement from the landlord.
However, tenant now wants to cancel the agreement altogethe and not take up occupation on OCtober 1st and receive the part paid deposit back.
The lease had a clause which now is proving to be not easy to understand:
'This offer shall become a final and binding agreement of lease upon acceptance hereof by the Landlord within thirty (30) days of signature hereof by the Tenant, without the Tenant having to be botified of same, and is irrevocable until then'
What does this clause mean, especially pertaining to the issue of cancelling the lease by the Tenant.
Your assistance will be greatly appreciated.
