Hi, I started the process of purchasing a house as an individual. The bank initially approved 100% of bond. The lawyers asked for certain documents and it was discovered that my husband and are are in fact married in community of property even though we got married outside the country and never registered our marriage in South Africa. We had assumed it was out of community for this reason. Lawyers advised it was in community. They requested an amended instruction from the bank for checks to be done in both our names. This took approximately three weeks and eventually came back as declined from all banks. The sellers lawyers then sent an email requesting payment for the wasted costs in respect to conveyancing required.they initiated transfer of property in my name. Am I liable for these costs even if declined second request"? And they took long to respond? Further to this I did not instruct the sellers lawyers to process paperwork.
