Good day
We tried to buy a property. The OTP was signed in June 2019
The bank insisted that the plans be up to date with Tshwane Metro.
By the end of September it transpired that not only was the plans not up to date, but there were significant problems with the property being over the building line, the there is a flat on the property that needs to be registered as a second home because it is too large in relation to the house, and not all structures were on the plans.
Two architects gave their opinion that this could delay the transfer for anything between 1-2 years.
Not only is the delay too long for us, but the suggested changes to conform would end up in something that would not have been acceptable to us when we made the decision to buy the properties.
Adding to our frustration is that we asked the estate agent 3 times whether the plans were up to date and she confirmed it three times.
We withdrew the OTP, but we are now being held responsible for costs.
