Hi there - The pool maintenace people recently came to give us a service aftewards the lady drove her car out at which point an accident happened : her hyundai ix35 was scratched by the automated gate when she was reversing. I was there to admit that shortly after i saw them drive out i went into the house to drink some water and I heard a car hooter outside I thought that it was lady letting me know that she is out of the driveway . I closed the gate while inside the house and after about 3 seconds I went to the door to see if the gate is closed-only to find the gate closing in on this car and it was too late to stop either one .Please note the following facts as backgground : the hyundai ix 35 belongs to the lady`s husband and it is under finance with tthe bank but there is no car insuarence, furthermore the lady says that her husband is retrenched. I , the respondent am also facing a difficult financial position because I am unemployed and without a place to stay. I have been given one quotation from a local Hyundai accredited panelbeater but it is too expensive and I have suggesteed to the aggrieved party to shop for cheaper quotations but they are not cooperating - Please advise what are my rights and how can I proteect myself from being ripped off ? hope to hear from you thanks -
