Question posted in the General Law category relating to Eastern Cape

My parents are divorced for more the 6 years now. My mother has left the house. The agreement in the divorce was that the house and everything in the house belongs to me and my sister. My mother took out a big loan 4 years ago. She is now failing to pay. The people that she borrowed from can't get a hold of her, they have come to our house with a summons saying they will take our furniture. Can they do that and what can we do?

If the furniture in the house belongs to your Mom, then they can take it.

BUT, if the furniture in the house belongs to guys, then they can't take it.

You can show the sheriff a copy of the divorce agreement which says this. Or you'd need to prove to the sheriff that you bought the stuff at the shops!
