Question posted in the Landlord Tenant Law category relating to Western Cape
Hi,
We are renting a property from a landlord in Cape Town. While we don't have a written contract, we do have an invoice for six months worth of rental payments and a verbal tenancy agreement (via email). Today the landlord has given us six weeks of notice to vacate the property at the end of Jan 2024 (a full two months before our lease was due to expire), citing personal difficulties in that her daughter is in the process of being evicted, and saying that she now needs to house her daughter in the property that we are renting.
• What are our rights under South African common law as tenants?
• Is our landlord within her rights to give us notice on what I believe to be a 6 month fixed term contract?
