I am considering filing for a divorce. My husband is a lawyer himself and I need to understand the impact of the decision on my financial status. The biggest problem - we just sold our existing house and bought a much bigger house. We are buying it together, so the debt will be on both of us. I have asked him to stop the purchase of the house but he does not want to, and says that even if we don't work out and end up in divorce, he will be able to afford the house on his own. This still makes me very nervous, as the debt will still be in my name?
I need to understand how spousal allowance/maintenance works too. Basically I need to figure out how much money I am going to have, can I afford a divorce. The house we just bought is just under 2.9 million. He earns around R120 000 per month and I earn just under 60k per month. I have a vehicle in my name, R8000 per month and I pay for everyone's medical aid ( R6000 per month) and then also the kids school fees. The rest if all pretty much covered by him, cell phones, insurance, food etc. The new house installment will be around 22k per month. I'm worried that I'm going to be left with nothing if I decide to divorce and what is my rights in terms of getting the house 'off' my name? I'm referring to the new house we bought. Obviously the bank approved the loan based on the two of us purchasing together.
In essence I need to understand what my financial status will be more or less if we divorce.
We have 2 kids and he wants full custody of them which I will have to fight too but first things first, the money involved naturally impacts my decision.
