Good day. My name is Yvonne and I need some advise. I am not sure if it falls within this category. 

I was gifted money by my mother to purchase ground and build a small house for myself and for her. Which all has been done, however she has decided that she no longer wants to live in the northern cape and has canceled the building of her wooden house. However she now wants to lay a charge of theft as she is saying she wants her money back. 

All the money was paid in to my Capitec account from her Capitec account and all the money was paid over from my Capitec account into the suppliers and sellers account. All the proof of available. She now wants to put the property on her name and sell it, leaving myself and two children and husband without a roof over our heads. 

To transfer the property to her will cost a few thousand which neither of us have. Also it was a payment she willingly made to me to put the property on my name. 

What legal grounds do I have to stand on and what legal ground does she have to sue me for theft. In terms of paying back the money she paid over, I think is ethically and morally correct, however I cannot pay over the full amount upfront. It will have to be what I can afford. 

I am unable to speak to her as she is volatile and shouts and swears at me.
