Afternoon,
Trust you are keeping well. i just need some adivice in the following matter please. My sister was in a car accident on the 16th January 2020. a Company bakkie drow straight into the back of her car leaving a lot of damages so that the car are writen off. She does not have insurance on the car or medical aid for that matter.
we did get in contact with the owner of the business to claim for the damages caused. he has sent us details for his insurance so that we can claim. But now the insurance company said that this is going to be a long proses and if i want to speed it up i have to get a letter of demand from attorney. i also need someone to go and asses the damages of the car and send it to them.
what i want to find out is, is this true about the letter of demand? and can i claim all this unnesisary costs back from the owner exp.
*doctors costs
*assesment of car costs
*car damages / if written of do they pay out the book value?
*attorneys costs - letter of demand?
how long does it normaly take to get a claim paid out, she is now sitting without transport and cant get to work?
Any advise on what i can do please

It really depends on the insurance company regarding the claim, e.g. if they accept liability, how much they think the damages actually are, and how much pressure you put on them!
Yes, you can sue them for all of the above.
You can also file a claim with the Road Accident Fund for the doctor costs!
