Question posted in the General Law category relating to KwaZulu-Natal
Good day,
I have swopped my car being a Mazda 2, which the bank holds the logbook, for a BMW 320i and a cash difference.
The deal was that I would be paid R12 000 via EFT immediately and the balance of R3000 when I arranged the license of the vehicle.
And we both would exchange logbooks when I settled the bank of R14 364 and obtained the logbook which was to be done by the 10/01/2020
Of the R12 000 , I paid R3000 to obtain the license and handover which left a balance of R9000 which I used to sort out a few things and have a small balance.
The guy refused to pay the balance of the R3000 from the initail R15 000 as he said the car was problematic, yet it was sold as is but I still complied.
Due to unforeseen circumstances I could not obtain the logbook to date as I am still awaiting more funds but now the guy wants to charge me R500 per day for everyday I am late with the logbook.
Can he do this as it was not part of the initial agreement.
I am already battling to get the log book arranged and wont be able to pay such large amounts and I am now under severe stress
