Question posted in the Consumer Protection Law category relating to Free State
Good day. I have a property which I am still in the process of constructing in an estate. I was self employed and had fallen behind with my levies and rates and taxes. Whenever I received payment, I would pay a huge amount I could afford at the time towards the debt. The Board of Directors (BoD)of the estate have together with their legal reps decided to put my property on auction to recoup the debt. I recently got full time employment in one of the government departments and as soon as I received my appointment letter, I notified the BOD's legal rep of the change in my financial situation, so I could make an arrangement to settle the debt as I now have a solid job. They didn't want to entertain my request and are going ahead with the auction. What legal recourse do I have to stop this auction from proceeding?

Hi there,
I see that you haven't made a payment for the question, but I'm going to assist you a little. If you want to ask a follow-up question, please make the required payment.
I assume that the HOA has already issued a summons and has already obtained a default judgment against you? Is that how they are putting your house on auction?
Has the sheriff attached your house?
Is it your primary residence?
If so, did they apply to the High Court to have your property declared specially executable?
