Question posted in the Consumer Protection Law category relating to Western Cape
Hi, in September I bought products from Mojome for R1998.00. It was for Collagen supplements. The day I got them, I took 1 scoop of each and by later that night, I was feeling I'll, like an allergic reaction. I immediately started taking antihistamines 3 times a day but was still not feeling right. 2 days later I added cortisone as well and started feeling better by the 5th day. The very next day after consuming the product, I sent an email explaining my problem but I was patronised and made to feel that it was all my fault! I sent all the products back to them.I did read their returns policy but these were extenuating circumstances, which I explained, and thought that they would understand. Many emails back and forth, they will not budge. They said they could only refund 2 unopened items, less a handling fee, so they wanted to give me back just R400 odd rands! I was so upset to gave lost R2000 just like that! I eventually replied that they must send it all back but heard absolutely nothing for them on nearly 2 months. I called them this morning and received a very threatening email. Please tell me what my legal rights are, if any. Thanks. Regards Beba Andric
Answer to the Question
Hi there,
I see that you haven't made a payment for the question, but I'm going to assist you a little. If you want to ask a follow-up question, please make the required payment.
I don't think that you have any right to return the opened product just because you are allergic to it. The consumer protection act does not make provision for that. If the products were not open, that would be a different story.
