Good day, we signed a rental agreement in the last week of June this year for a year duration. In the contract it states that if we cancel our contract early we will need to pay minimum two months or maximum 3 months penalty as well as agent fees and advertising etc. We then had an opportunity presented to us to move to kzn so we gave 31 working days notice. We were under the impression that the consumer act allows for us to pay only one month penalty fee- do we have to pay up to 3 months full rental should they not find a suitable tenant now with the new lockdown rules? The agent has made it clear that if they find a tenant who is willing to pay the huge deposit that they require (which already put one potential tenant off) and their credit check is good but they don't like the potential tenant, then they won't take them and we they will keep looking for tenants. Our rental is R20000 per month- we don't have R60000 to waste.
We reported roof leaks in November and they still have not been sorted out.
