Question posted in the Landlord Tenant Law category relating to Gauteng

Good day,

we are tenants in the matter.

We were renting from our previous landlord for 1 year. They are withholding our deposit citing that damage to paint was not fair wear and tear and thus needed to repaint the entire interior of the house.

The paint used was not good quality as we could not even wash the walls without the paint coming off. In our new house that we bought, we are able to wash the walls whenever there's dirt (as we have kids).

The tenant says we are liable for 100% of the costs of painting, does the lifespan of paint not factor into how much we are liable for and if so what law or case law can we reference?

Thank you
